fa تحلیل جامع حقوقی و اجرایی کمیسیون ماده ۱۲ قانون زمین شهری: چالش‌ها، کارآمدی و چشم‌انداز تحول عمومى General پژوهشي Research <div style="text-align: justify;"><span style="font-size:10px;"><span style="line-height:29.0pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span calibri=""><span lang="FA"><span b="" lotus="">کمیسیون ماده ۱۲ قانون زمین شهری، به‌عنوان نهادی کلیدی در نظام حقوقی و شهرسازی ایران، وظیفه تشخیص نوع زمین (دایر، بایر، موات) و پاسخ به استعلامات مراجع مختلف را بر عهده دارد. این نهاد با هدف حفظ حقوق مالکانه، پیشگیری از تصرفات غیرقانونی، و تأمین اراضی برای طرح‌های عمرانی تأسیس شده است. این پژوهش با روش توصیفی-تحلیلی و با استناد به منابع حقوقی و پژوهشی معتبر، به بررسی عمیق ساختار، صلاحیت‌ها، چالش‌های حقوقی و اجرایی، و راهکارهای بهبود کارآمدی کمیسیون می‌پردازد. نتایج نشان می‌دهد که علی‌رغم دستاوردهای نسبی، موانعی نظیر ناکارآمدی ساختاری، کمبود تخصص اعضا، فقدان زیرساخت‌های دیجیتال، و ابهامات قانونی، عملکرد این نهاد را محدود کرده است. پیشنهادات این مطالعه بر اصلاحات ساختاری، دیجیتالی‌سازی فرآیندها، تقویت هماهنگی بین‌نهادی، و بازنگری قوانین متمرکز است تا کارآمدی و شفافیت کمیسیون افزایش یابد. </span></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:12.0pt"><span style="line-height:107%"><span new="" roman="" style="font-family:" times="">The Commission on Article 12 of the Urban Land Law, as a key institution in the legal and urban planning system of Iran, is responsible for identifying the type of land (useful, barren, and unsuitable) and responding to inquiries from various authorities. This institution was established with the aim of protecting property rights, preventing illegal occupations, and providing land for development projects. This study, using a descriptive-analytical method and citing reliable legal and research sources, conducts an in-depth examination of the structure, competencies, legal and executive challenges, and strategies for improving the efficiency of the commission. The results show that despite relative achievements, obstacles such as structural inefficiency, lack of expertise among members, lack of digital infrastructure, and legal ambiguities have limited the performance of this institution.
