fa قلمرو مسئولیت در قراردادهای خارج از عرف قانونی (موردمطالعه: معاملات ارزی و کالاهای ویژه مناطق آزاد) عمومى General پژوهشي Research <div style="text-align: justify;"><span style="font-size:18px;"><span style="font-family:nasimYW;"><span style="line-height:normal"><span style="direction:rtl"><span style="unicode-bidi:embed"><span lang="AR-IQ">مسئولیت مدنی یکی از موضوعات مهم مورد ابتلای جامعه است که هر روز بر شاخه‌ها، مصادیق و گونه&shy;</span><span lang="AR-IQ">های آن افزوده می</span><span lang="AR-IQ">‌شود. اصولاً بخش مهمی از زندگی انسان‌ها را در جامعه مقوله قراردادهایی بنا نهاده است که منعقد گردیده‌اند. زیرا به پشتوانه این عقود و قراردادها، زندگی اجتماعی و اقتصادی همگان معنای عملیاتی و اجرایی می‌یابد و فرایند کار و امور اقتصادی مردم را سامان بخشیده و ممکن می‌سازد. به همین دلیل انسان همواره در جستجوی آن است تا بتواند برحسب قول و قرار و وعده‌ای که بین او و دیگری منعقدشده است، پایبند باشد. به همین منظور در این پژوهش، قلمرو مسئولیت در قراردادهای خارج از عرف قانونی به‌عنوان محور پژوهش قرار گرفت. گفتنی است که این پژوهش به شیوه تحلیلی- توصیفی به رشته تحریر درآمد و مقوله مسئولیت مدنی قراردادهای خارج از عرف موردبررسی قرارگرفته است. نتایج بیانگر آن است که قراردادها در قالب عقود مختلف، بایسته‌های حقوقی را به ارمغان خواهند آورد که اساس هنجارهای تجاری و مدنی را تشکیل داده و همچون یک پیشرانه قوی، سکان زندگی را به حرکت درخواهند آورد. بنابراین الزامات غیر قراردادی یا خارج از قرارداد، به‌واسطه‌ ارتکاب جرم برای افراد ایجاد می‌شوند که به آن‌ها مسئولیت کیفری گفته می‌شود یا بدون آنکه جرمی رخ‌داده باشد، یک شخص در مقابل شخص دیگر مسئول شناخته‌شده و تکالیفی بر عهده‌اش گذاشته می‌شود که به آن مسئولیت مدنی می‌گویند.</span></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:18px;"><span style="font-family:Times New Roman;"><span style="line-height:normal">Civil responsibility is one of the important issues affecting the society, and its branches, examples and types are added every day.
