fa کاربست اصول حکمرانی در لایحه حجاب و عفاف 1402 عمومى General پژوهشي Research <div style="text-align: justify;"><span style="font-size:18px;"><span style="font-family:nasimYW;"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" times=""><span lang="FA"><span 2="" lotus="">هدف تحقیق حاضر، بررسی کاربست اصول حکمرانی خوب در لایحه حجاب و عفاف مصوب 1402 می&lrm;باشد. حکمرانی خوب، واژه‌ای است که بیانگر تغییر پارادایم نقش دولت و حکومت‌ها است که زمینه را برای مشارکت یکسان و برابر تمام شهروندان در فرآیند تصمیم‌گیری فراهم نموده و بیانگر این واقعیت است که حکمرانی متعلق به مردم است و توسط مردم شکل می‌گیرد. یکی از تصمیم‌گیری‌های اخیری که با انتقادات بسیاری همراه بوده است، تصویب لایحه حجاب و عفاف می&lrm;باشد که منتقدین بر این نظر هستند که در فرآیند تصویب این لایحه، اصول حکمرانی خوب رعایت نشده است. همین امر موجب شده این سوال مطرح گردد که در لایحه حجاب و عفاف تا چه میزان اصول حکمرانی خوب مدنظر قانونگذار قرار گرفته است؟ یافته‌ها نشان از آن دارد که، برای دستیابی به قانون‌گذاری مطلوب و ایجاد قوانین کارآمد، استفاده از اصول حکمرانی خوب بسیار حائز اهمیت است، زیرا این اصول هستند که در قانون‌گذاری برای تضمین عدالت، شفافیت و مشارکت عمومی در فرآیند تصویب قوانین بسیار مهم هستند. اما هرچند تصویب لایحه حجاب و عفاف انتقادات بسیاری را از سوی صاحبنظران به دنبال داشته است، اما جهت اجرای این لایحه در جامعه بایستی اصول حکمرانی مدنظر قرار گیرد تا ضمن تحقق اصول حکمرانی مطلوب، از سوی جامعه مورد پذیرش واقع گردد و نهایتا حقوق و آزادی‌های شهروندان در سایه این امر تضمین گردد.</span></span></span></span></span><br> &nbsp;</span></span></div> <div style="text-align: justify;"><span style="font-size:18px;"><span style="font-family:Times New Roman;"><span style="unicode-bidi:embed"><span new="" roman="" times="">The aim of this research is to examine the application of good governance principles in the approved Hijab and Chastity Bill of 1402. Good governance is a term that signifies a paradigm shift in the role of government and governance, creating the grounds for equal participation of all citizens in the decision-making process and acknowledging the fact that governance belongs to the people and is shaped by them. One of the recent decisions that has been accompanied by numerous criticisms is the approval of the Hijab and Chastity Bill, with critics arguing that the principles of good governance have not been observed in the process of passing this bill. This raises the question of to what extent the principles of good governance have been considered in the Hijab and Chastity Bill. The findings indicate that the use of good governance principles is crucial for achieving desirable legislation and creating effective laws, as these principles are essential in ensuring justice, transparency, and public participation in the process of lawmaking.
