fa انعکاس اندیشه‌های روان‌شناسی جرم و جنایی پیرامون رفتار مجرمانه در رویه قضایی Reflecting the Thoughts of Crime and Criminal Psychology on Criminal Behavior in Judicial Procedure عمومى General پژوهشي Research اساساً روان‌شناسی جنایی علم مطالعه شخصیت بزهکاران و نیز روش‌های بازاجتماعی شدن آنان و بررسی نقش محیط (به معنای عام) بر رفتار مجرمانه است. به دلیل اهمیت موضوع، پژوهش حاضر با هدف بررسی انعکاس اندیشه‌های روان‌شناسی جرم و جنایی پیرامون رفتار مجرمانه در رویه قضایی، در قالب متدلوژی پژوهش تحلیلی-توصیفی به رشته تحریر درآمده است. یافته‌های مستخرج از این نگاره که براساس تحقیقات مطالعات کتابخانه&lrm;&lrm;ای ترسیم گردیده، حاکی از آن است که در چارچوب فرایندهای دادرسی و صدور احکام در ادوار جاری، نیازمند آن هستیم تا مراجع قضایی صالح، ریشه‌های روان‌شناسی جرم را در هنگامه بررسی پرونده‌های قضایی با ژرفای بیشتری دنبال نمایند. زیرا این مقوله، عنصر بسیار مهمی است تا جاییکه گاهاً بتواند مسیر پرونده و دادرسی را به سوی واقع‌تر شدن رسیدگی، و عدالت ورزی فزون‌تری در دستگاه قضرهنمون شود. چه بسا آنکه در سالیان اخیر، نسبتاً انعکاسی از رویکردهای جرم‌شناسی با محوریت روان‌شناسی جرم در قاموس قضایی کشور، محسوس بوده، اما کافی نیست. پس می‌توان نتیجه گرفت که عوامل روانی در ارتکاب جرم تاثیر فراوانی داشته و همین امر موجب ارتباط هر چه بیشتر حقوق جزا با علم روان‌شناسی کیفری یا جنایی می‌شود. گفتنی است مهمترین چیزی که در بررسی شخصیت مجرمانه افراد مشهود است، باورهای غلطی است که در نهاد شخص مجرم نهفته شده که باعث می‌‌شود وی بر اساس لذت‌جویی و خواسته‌هایی که برگرفته از نهاد اوست میل به ارتکاب جرم پیدا کند و انگیزه‌هایی را که از نظر مادی برای خود ترسیم کرده به مرحله ظهور برساند. درواقع شخص بزهکار مکرر همه چیز را بر اساس معیار شخصی خودش بررسی و در محاسباتش افراد دیگر را لحاظ نمی‌کند. معیار اخلاقی خود اوست و این خود است که به عمل مجرمانه مشروعیت داده، در حالی که قضاوت دیگران یا قانون در ملاحظات او دخیل نیستند.   Basically, criminal psychology is the science of studying the personality of criminals as well as their resocialization methods and examining the role of the environment (in a general sense) on criminal behavior. Due to the importance of the subject, the current research has been written in the form of analytical-descriptive research methodology with the aim of investigating the reflection of the thoughts of crime and criminal psychology on criminal behavior in judicial procedure. The findings extracted from this picture, which was drawn based on the research of library studies, indicate that in the framework of the judicial processes and the issuance of sentences in the current era, we need competent judicial authorities to examine the roots of the psychology of crime when examining judicial cases with Follow more deeply. Because this category is a very important element to the extent that it can sometimes lead the way of the case and proceedings towards more realistic handling and more justice in the judicial system. It may be that in recent years, a relatively reflection of criminological approaches centered on the psychology of crime has been noticeable in the judicial dictionary of the country, but it is not enough. So, it can be concluded that psychological factors have a great impact on the commission of a crime, and this causes the connection of criminal law with the science of criminal or criminal psychology. It should be said that the most important thing that is evident in the study of the criminal personality of people is the wrong beliefs that are hidden in the institution of the criminal person, which causes him to find a desire to commit a crime based on the pleasure-seeking and desires that are derived from his institution, and the motivations that are materially Draw for yourself and bring it to the emergence stage.
