fa جایگاه مسئولیت مدنی دولت درفضای سایبری با تاکید بر مقررات حقوق بین‌الملل The Position of Government's Civil Responsibility in Cyberspace with Emphasis on International Law Regulations عمومى General پژوهشي Research موضوع مقاله پیش رو جایگاه مسئولیت مدنی دولت در فضای سایبری است. از آنجا که مسئولیت مدنی یکی از مهمترین بخش‌های حقوق مدنی است این، مسئولیت ممکن است در نتیجه عمل مستقیم و یا غیر مستقیم دولت به مفهوم عام آن و مستخدمین دولتی به مفهوم خاص و یا اشخاصی که تحت اراده دولت‌ها عمل کنند، صورت پذیرد در حال حاضر بسیاری از خدمات اجتماعی و رفاهی در اکثر کشورها توسط دولت به صورت الکترونیکی و آنلاین و در فضای سایبری صورت می‌پذیرد. در راستای ارائه این خدمات ممکن است در نتیجه تقصیر یا خطای دولت و مستخدمین دولتی، زیانی به اشخاص خصوصی و... وارد آید که در صورت ایراد خسارت، موضوع مسئولیت دولت در فضای سایبر تحقق می‌یابد. در عرصه بین‌الملل نیز دولت‌ها از طریق فضای سایبر می‌توانند وارد نبرد سایبری که مفهومی ‌نوظهور در عرصه بین‌الملل است، شوند و خساراتی را به دولت هدف وارد آورند که ممکن است این خسارات، تبعات زیانباری را در بخش اقتصادی، سیاسی، نظامی ‌و... در پی داشته باشد. همه این مسائل در عرصه بین‌الملل ممکن است برای دولت مرتکب مسئولیت بین‌المللی به وجود آورد که بر طبق حقوق و عرف بین‌الملل دولت خاطی ملزم به جبران خسارت به انحاء مختلف از جمله توقف وعدم تکرار کسب رضایت و پرداخت غرامت خواهد بود. این رساله نیز در صدد آمده تا حوزه مسئولیت دولت در فضای سایبر را با توجه به مقررات حقوق بین‌الملل بررسی نماید.   The topic of the upcoming article is the place of civil responsibility of the government in the cyber space. Since civil responsibility is one of the most important parts of civil rights, this responsibility may occur as a result of the direct or indirect action of the government in its general sense and government employees in a specific sense or persons who act under the will of governments. Currently, many social and welfare services in most countries are provided by the government electronically and online in cyber space. In order to provide these services, as a result of the fault or error of the government and government employees, damage may occur to private individuals, etc., and in case of damage, the issue of the government's responsibility in the cyber space will be realized. In the international arena, governments can engage in cyber warfare, which is an emerging concept in the international arena, through the cyber space, and cause damages to the target government, which may have harmful consequences in the economic, political, military, and... follow. All these issues in the international arena may create international responsibility for the guilty government, which according to international law and custom, the wrongful government will be required to compensate the damage in various ways, including stopping and not repeating obtaining consent and paying compensation.
