fa مشروعیت حمله ترکیه به سوریه از منظر حقوق بین‌الملل The legitimacy of Turkey's attack on Syria from the perspective of international law عمومى General پژوهشي Research به‌طور بنیادین باید چنین اشعار داشت که تجاوز به خاک کشور یا سرزمینی دیگر، لمحه‌ای از تجاوز را دربرخواهد داشت. زیرا بسیاری از مواد مندرج در هسته حقوقی شورای امنیت سازمان ملل متحد، این موضوع را از نظر گذرانده و اعضاء نیز بدان واقف می‌باشند. البته این مقوله دارای استثنائات و تبصره‌هایی است، اما در صورتیکه رضایت کامل دولت میزبان مبنی بر حضور نیروهای نظامی دیگر کشورها در جغرافیای سرزمینی خویش را تأیید ننماید، نوعی ازاله حق صورت گرفته که قابل پیگیری و مراجعت به نهادهای بالادستی بین‌المللی نیز خواهد بود. به دلیل اهمیت این موضوع، پژوهش کنونی نیز مقوله حمله دولت ترکیه را از حیث ابعاد و نصوص حقوقی و قانونی علیه دولت سوریه مورد کنکاش قرار داده است که این پژوهش، به شیوه تحلیلی- توصیفی با رویکرد استنباطی با این هدف به رشته تحریر درخواهد آمد تا ماهیت تجاوز، ضایع شدن حق جغرافیای سرزمینی و مواردی از این قبیل را در اثر حوادث سالیان اخیر همچون حضور داعش در منطقه و متعاقب آن، مهاجمه نظامی ترکیه ضد دولت سوریه به وقوع پیوسته است، بررسی نماید. یافته‌های پژوهش حاکی از آن است که اساساً حمله ترکیه به خاک سوریه قطعاً عامل ایجاد بی‌ثباتی و تنش در منطقه خواهد بود و شرایط را پیچیده‌تر خواهد کرد. همان‌طور که تعدادی از کشورهای عرب خاورمیانه مواضع منفی در قبال ترکیه داشته‌اند و مواضع آن‌ها در روزهای اخیر چندان به نفع ترکیه نیست و تا حدودی در میان آن‌ها تنها مانده است.   Fundamentally, it must be said that rape on the territory of another country or territory will constitute an area of rape. Because of the importance of this issue, the present study also explores the scope of the Turkish government's attack on the Syrian government in terms of its legal and legal aspects. To investigate the nature of the aggression, the loss of territorial geography and the like in recent years, such as the presence of ISIS in the region and, subsequently, the Turkish military offensive against the Syrian government. The findings of the study suggest that essentially the Turkish invasion of Syria will certainly cause instability and tension in the region and make the situation more complicated.
