fa جرم انگاری جرائم نوپدید با بهره‌گیری از هوش مصنوعی Criminalization of Emerging Crimes Utilizing Artificial Intelligence عمومى General پژوهشي Research <div style="text-align: justify;">پیشرفت‌های هوش مصنوعی در سال‌های اخیر، فرصت‌های جدیدی را برای جامعه بشری به ارمغان آورده است. بااین‌حال، این پیشرفت‌ها، خطرات و چالش‌های جدیدی را نیز به وجود آورده‌اند. یکی از این چالش‌ها، افزایش جرائم مرتبط باهوش مصنوعی است. با گسترش استفاده از فناوری‌های جدید، شناسایی و مقابله با جرائم نوپدید اهمیت ویژه‌ای پیداکرده است. جرم‌انگاری این جرائم به‌منظور حفاظت از حقوق افراد، حفظ امنیت جامعه و پیشگیری از گسترش فعالیت‌های غیرقانونی در فضای مجازی ضروری است. عدم جرم انگاری این جرائم، می‌تواند منجر به افزایش آن‌ها و آسیب‌های جدی به جامعه شود. جرائم نوپدید هوش مصنوعی، جرائم مرتبط با فناوری جدید است که ناشی از استفاده از این فناوری است که می‌توان به فیشینگ، فارمینگ، قماربازی اینترنتی، کلاه‌برداری اینترنتی اشاره نمود. جدید و نوپدید بودن این فناوری و جرائم ارتکابی در این حوزه، متضمن این امر است که برخی از این جرائم، در انعکاس اندیشه‌های قانون‌گذار متجلی نشده است و جرم انگاری آن نیز محقق نشده است. تحقیق حاضر که با روش توصیفی-تحلیلی انجام‌گرفته است درصدد بررسی امکان جرم انگاری جرائم ارتکابی با استفاده از هوش مصنوعی است. یافته‌های تحقیق نشان از آن دارد که، با توجه به جرائم ارتکابی از طریق هوش مصنوعی، می&lrm;توان بنابر اصول مختلفی قائل به امکان جرم انگاری این قسم از جرائم بود. به بیانی، بر طبق اصولی ازجمله اصل لا ضرر، مصلحت و..... می&lrm;توان قائل به جرم انگاری جرائم نوپدید بود.  </div> <div style="text-align: justify;">Recent advancements in artificial intelligence (AI) have brought new opportunities to human society. However, these advancements have also introduced new risks and challenges. One of these challenges is the rise in crimes related to AI. As the use of new technologies expands, identifying and combating emerging crimes has become particularly important. The criminalization of these crimes is essential to protect individual rights, maintain community security, and prevent the spread of illegal activities in cyberspace. Failure to criminalize these crimes can lead to their increase and cause serious harm to society. AI-related emerging crimes are those associated with new technology, arising from its use, such as phishing, pharming, internet gambling, and internet fraud. The novelty and emergence of this technology and the crimes committed in this field imply that some of these crimes are not yet reflected in the legislature's thoughts and thus have not been criminalized. This research, conducted through a descriptive-analytical method, seeks to examine the possibility of criminalizing crimes committed using AI. The findings of the research indicate that, considering the crimes committed through AI, it is possible to argue for the criminalization of these types of crimes based on various principles.
