fa بررسی اثر شفافیت و ضمانت اجراهای قوانین تجارت در تحقق اهداف سازمان تجارت جهانی عمومى General پژوهشي Research <div style="text-align: justify;"><span style="font-size:18px;"><span style="font-family:nasimYW;"><span style="line-height:normal"><span style="direction:rtl"><span style="unicode-bidi:embed"><span lang="AR-SA">&nbsp;شفافیت همواره به عنوان یکی از اصول مهم سازمان تجارت جهانی تلقی گردیده است. بررسی رویکرد سازمان تجارت جهانی می‌تواند ابزارها و رویه‌هایی که این سازمان جهت بلوغ و تکامل این اصل مدنظر قرار داده است را تبیین نماید. به دلیل اهمیت خاص این موضوع، هدف پژوهش جاری ارائه پاسخی مناسب برای این مسئله است که اثر شفافیت و ضمانت اجراهای قوانین تجارت در تحقق اهداف سازمان تجارت جهانی با رویکرد عضویت دولت‌ها در آنها چه خواهد بود؟ گفتنی است که روش پژوهش در این جستار به صورت تحلیلی-توصیفی و همچنین روش گردآوری اطلاعات در قالب مطالعات کتابخانه‌ای می‌باشد. نتایج بیانگر آن است تقریبا در تمامی موافقتنامه‌های این سازمان شاهد مقرره‌‌ای پیرامون شفافیت هستیم و در واقع، اصل شفافیت فرایندی در حال تکامل و رو به رشد داشته و سیر این تکامل، بنحوی بوده است که به عنوان مبنایی جهت تغییر در ساختار این سازمان مدنظر قرار گرفته و این امکان را فراهم آورده است که بر اساس آن تلاش‌‌هایی جهت اصلاح فرایندهای ایجاد خط مشی‌های تجاری در سیستم داخلی اعضا، صورت پذیرد. </span><span lang="FA">همچنین تبیین گردید که شفافیت می‌تواند به موتور محرک کشورها در افزایش حجم معاملات تجاری و بازرگانی، استفاده از قوانین رقابت مطابق با حقوق بین‌الملل، استفاده از ظرفیت‌های حمایت از محصولات و کالاهای اختصاصی و مالکیت آنها در سراسر جهان و همچنین در صورت بروز اختلاف، از پتانسیل نهاد داوری نیز استفاده نماید. همچنین شفافیت قراردادهای مذکور و تضمینات اجرای آنها سبب خواهد شد که دولت‌ها به مراتب با سهولت بیشتری به عضویت نهادها و سازمان‌های زیرمجوعه سازمان تجارت جهانی درآیند.</span><span dir="LTR"><span style="font-family:&quot;Times New Roman&quot;,serif"></span></span></span></span></span></span></span><br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:18px;"><span style="font-family:nasimYW;"><span style="line-height:normal">Transparency has always been considered as one of the important principles of the World Trade Organization. Examining the approach of the World Trade Organization can explain the tools and procedures that this organization has considered for the maturity and evolution of this principle. Due to the special importance of this issue, the aim of the current research is to provide a suitable answer to this question, what will be the effect of transparency and guarantee of the implementation of trade laws in the realization of the goals of the World Trade Organization with the approach of the governments&#39; membership in them? It should be mentioned that the research method in this thesis is analytical-descriptive as well as the method of collecting information in the form of library studies. The results show that in almost all the agreements of this organization, we see regulations about transparency, and in fact, the principle of transparency has been evolving and growing, and the course of this evolution has been in such a way that it is considered as a basis for changes in the structure of this organization and has made it possible to make efforts to improve the processes of creating business policies in the internal system of the members. It was also explained that transparency can be the driving force of countries in increasing the volume of trade and commerce, using competition rules in accordance with international law, using the capacities to protect products and proprietary goods and their ownership around the world, and also in case of disputes, from The potential of the arbitration institution should also be used.
